Darren Canning’s appeal against his three-year burglary sentence was dismissed by the Court of Appeal on 26 May 2016. He had pleaded guilty to burglarising an apartment at Carrig Court, Fortunestown Way, Tallaght, and was sentenced at Dublin Circuit Criminal Court to three years in prison.
The court found the sentence could not be considered excessive, and said the sentencing judge was entitled to treat Canning’s resistance during arrest as an aggravating factor. The judgment also held that the absence of a rehabilitative element did not amount to an error.
