Dany Boon was awarded €4.87 million in damages in the High Court on 13 December 2022, after the judge found several entities had defrauded him.
Mr Justice Brian O’Moore said he was satisfied Mr Boon had been defrauded by Thierry Fialek-Birles and companies associated with him. The court also appointed receivers and made permanent freezing orders over linked assets, and directed defendants to pay Mr Boon’s legal costs.
The court declined to make a damages award against another defendant, Sail & Motor Navigation Company Limited in Antigua and Barbuda. Although the company had not participated in the proceedings, the court held that there was insufficient evidence to make an award against it.
Receivers were to sell three sailing boats, a house in Youghal and funds held in bank accounts to satisfy the judgment. Two companies continued to contest Mr Boon’s claims; proceedings against them were due to return before the court in January.
