Enoch Burke remained in jail for contempt of court after Mr Justice Conor Dignam refused his request for release at a hearing on 13 December 2022.
Burke had been committed to prison for breaching an injunction requiring him to stay away from Wilson’s Hospital School in Co Westmeath.
The judge said Burke could secure release by purging his contempt and complying with the court order.
Burke maintained that complying would conflict with his Christian beliefs and asked to be freed for Christmas.
His appeal against the injunctions was due to be heard in February, while the school’s action remained pending in the High Court.
