The Court of Appeal rejected several grounds of Philip Dunbar's appeal against his murder conviction in a judgment delivered by Mr Justice Edwards on 30 January 2024.
A jury convicted Dunbar of murder at the Central Criminal Court on 2 November 2020. The case concerned the stabbing death of Adam Muldoon at Butler's Park in Tallaght after the two went there together late on 22 June 2018.
The judgment said Dunbar accepted in a voluntary Garda statement that he must have stabbed and killed Muldoon, but said he did not remember the stabbing. He described hearing voices and referred to taking drugs.
The appeal raised issues including the refusal to discharge the jury, diminished responsibility, interview evidence, CCTV and rulings concerning a prosecution witness. The court rejected the jury-discharge, diminished-responsibility, interview and CCTV grounds discussed in the extract. It also rejected some grounds concerning the witness.
