Pat Burke, John Donnelly and John Fleming were granted leave to defend Promontoria’s €9,687,433.70 claim in the High Court on 19 December 2018.
Mr Justice David Barniville found they had raised an arguable case that the claim was statute barred, requiring a further hearing.
The court refused leave on their other proposed defences, including challenges to Promontoria’s entitlement to maintain the proceedings and to the loan transfer evidence.
The claim arose from a loan facility advanced by EBS Building Society to the defendants, trading as the Bridgeford Partnership, in February 2009.
