BARRY McARDLE loses bail appeal over manslaughter charge

By Donal Gilhooly

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

BARRY McARDLE’s bail appeal over voluntary manslaughter and concealing a body was dismissed by the Court of Appeal on 27 June 2019.

The appeal concerned his detention pending a High Court hearing on whether he should be surrendered to the Netherlands under a European arrest warrant.

The judgment records that McArdle had been acquitted of manslaughter at trial but convicted of concealing a body from criminal investigation, receiving a two-year sentence. The Amsterdam Court of Appeal later overturned the acquittal and imposed an overall 13-year sentence, which was under cassation review in the Netherlands.

The Court of Appeal found no error in the High Court’s risk assessment and held that refusing bail was within the judge’s discretion.

This report covers an earlier stage of the case. Later developments are not reported here.
