Barricade Inn occupiers ordered out over trespass

Mr Justice Paul Gilligan granted a High Court injunction requiring Barricade Inn occupiers to leave, with a 14-day stay allowing time to move out. The proceedings were reported on 20 January 2016.
The former Neary’s Hotel on Parnell Street had housed the Barricade Inn, a vegan café and social club, since March of the previous year. Lawyers for the owners sought the injunction because they said the building was dangerously unsafe.
Mary Bergin, executrix of Ellen McGuill’s estate, and Vandelure Ltd, which held the property’s freehold interest, brought the proceedings against unnamed people.
The application first reached court in October. Lawyers for James Cleaver, the only person who appeared to answer it, questioned Vandelure’s ability to seek an injunction because it allegedly had no living directors when proceedings began. Lawyers for the applicants said Ellen McGuill had been a shareholder and Mary Bergin was a company member as executrix. After an adjournment to address the issue, the court was told two new directors had been appointed following an EGM, allowing the application to proceed.
Edward Walsh, representing James Cleaver, said his client agreed to the injunction on terms that included a two-week stay and no costs order against him. The judge found the evidence justified granting an injunction pending a full hearing.
The order required James Cleaver and anyone aware of the orders to leave, return possession and clear their belongings and stored items. It also barred the defendants from returning before the full case was heard.
