Anthony Freeman and Miriam Freeman lost their claim in the High Court on 29 May 2014, seeking to invalidate a receiver’s appointment over six Dublin investment properties.
The couple had refinanced the properties with Bank of Scotland (Ireland) Ltd before defaulting on the loan facilities. Bank of Scotland plc later appointed a receiver under contractual rights following a cross-border merger.
Mr Justice Brian J. McGovern held that the bank properly securitised the loans and was entitled to appoint the receiver. He rejected arguments concerning Central Bank codes, registration of title and an interest-calculation error, and dismissed the claim.
