Alan Bradley's theft conspiracy remission case adjourned

By Eimear Byrne

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Alan Bradley's High Court challenge over enhanced remission for conspiracy to commit theft was adjourned by Ms Justice Ní Raifeartaigh in a judgment delivered on 26 May 2017. The court said the Minister had not disclosed the materials behind the refusal of his application.

The court held that enhanced remission was discretionary, rather than an entitlement, and that the decision-maker had to consider matters including public safety, the gravity of the offence and the prisoner's efforts to address offending behaviour.

Ms Justice Ní Raifeartaigh gave Bradley liberty to make a formal claim of privilege concerning any Garda report and to disclose information before the decision-maker. The judgment was not final.
