The Labour Court varied an adjudication officer’s decision and ordered Dualway Group to pay bus driver Declan Healy €1,500 compensation. The determination was signed on 11 May 2017.

Healy appealed after the officer found his complaint well founded but made no compensation award. Dualway admitted it had not notified him of the mobile road transport working-time rules before he complained, and said it later took steps to notify current and future employees. Healy said notification mattered for his health and safety and that of the public.

The Court found the officer had erred by making no award for the breach of Healy’s rights. It treated Dualway’s later steps as a mitigating factor and ordered the company to pay €1,500 for the regulation 11 infringement.
