The Labour Court found Pumpower Ltd did not qualify under the construction industry Registered Employment Agreement on pensions, assurance and sick pay. The decision was dated 9 January 2006. The Building And Allied Trades Union argued that the company’s supply and installation work brought it within the agreement. Pumpower said its principal business was hiring and selling pumps and it was not involved in installation. The Court was not convinced that Pumpower’s principal business was construction and found the company was not covered by the agreement.
