The Labour Court dismissed Ciaran Quinlan’s appeal against the rejection of his protected disclosure complaint against the Health Service Executive, affirming the adjudication officer’s decision. The determination was dated 19 February 2024.

Quinlan, a grade 8 internal auditor, said he had made a protected disclosure in 2015 about HSE governance and was penalised in 2021 through remote auditing and the work assigned to him. The HSE disputed that he had made a protected disclosure and denied penalising him. It said remote audits had been introduced for staff generally during the Covid period.

The Court found Quinlan had not established a link between remote auditing or his assigned work and the disclosure six years earlier. It concluded he was not penalised for making a protected disclosure.
