Labour Court upholds recommendation in Hotel Kilkenny probation dismissal case

The Labour Court upheld a recommendation that a worker dismissed during probation had not been unfairly dismissed and should receive one week’s notice pay. The recommendation, dated 12 April 2024, concerned a worker at Griffin Group Hotels T/A Hotel Kilkenny. The worker said her dismissal came as a surprise because she had received little feedback between her three-month review and the end of probation. The employer said she needed further training and continued to struggle with opening shifts and checking rooms. The Court found that she had been afforded fair procedure when her employment was ended after she did not pass probation. It noted that the one week’s notice pay had already been paid.
