The Labour Court rejected South Dublin County Council worker Eugene McDonagh’s appeal for permanent appointment to an acting-up role and compensation. The Court’s decision was dated 30 August 2019.

McDonagh had served as Acting Assistant Foreman of Works for more than 12 years before returning to his painter grade. He said he expected the role to be made permanent under a 2013 agreement and claimed a loss of about €16,000 a year in pay and allowances. The council said its Workforce Plan required a competitive process for regularising acting arrangements. The Court said it could not uphold appointment on a personal-to-holder basis because the plan required competition, and found his compensation claim not well founded.
