Labour Court rejects worker’s appeal against Health Service Executive investigation

The Labour Court rejected a worker’s appeal against the Health Service Executive over its handling of complaints made by and against him. The recommendation was signed on 12 December 2018. The worker argued that investigators had failed to address clinical management issues included in their agreed terms of reference. The Health Service Executive said its procedures had been followed. The Court found that the employer had gone beyond its normal procedures to accommodate the worker’s concerns and that the investigators had complied with their terms of reference. The worker’s appeal failed, and the Adjudication Officer’s recommendation was varied accordingly.
