The Labour Court recommended an independent expert review of a worker’s promotion scores at Trinity College Dublin after finding the promotions procedure did not comply with its rules. The decision was signed on 22 May 2017. The worker had appealed an Adjudication Officer recommendation that did not support his claim. The Court found it was unsafe to refer his application back to the same committee. It recommended that an independent expert review his scores, recalibrate them if appropriate and decide whether he would or should have been promoted. The expert’s decision will bind both sides, and Trinity College Dublin must pay the expert’s costs.
