Labour Court recommends removing worker’s HSE job application record after appeal

The Labour Court did not uphold a worker’s appeal over an HSE Maintenance Foreman recruitment competition, but recommended removing the worker’s application record from their personnel file. It varied the Adjudication Officer’s decision in a recommendation dated 10 May 2017. The worker, represented by the Technical, Engineering and Electrical Union, argued that the interview board lacked the knowledge to assess candidates fairly and failed to recognise the worker’s qualifications. National Recruitment Service HSE said it used a structured, competency-based process and treated candidates equally. The Court said it could not second-guess the board’s selection decisions. It also noted that the worker had not exhausted the available appeal process and said the CPSA was responsible for considering compliance with the approved code.
