The Labour Court upheld a worker’s claim for a 39-hour contract under Tesco Ireland Limited’s 2006 collective agreement, in a decision dated 8 May 2017. The worker, represented by Mandate, said she had worked 39 hours a week for 16 weeks and met the agreement’s criteria. Tesco said the extra hours were worked during busy periods and it could not provide a 39-hour contract. The Court found the worker qualified under the agreement. It upheld the Adjudication Officer’s recommendation for a contract backdated to 5 February 2015 and €500 redress for how Tesco handled her grievance.
