Labour Court recommends €1,000 settlement for Dublin City Council worker

The Labour Court recommended that Dublin City Council pay an anonymised worker €1,000 in full and final settlement of a dispute over his reassignment. The recommendation, signed on 14 December 2016, followed the Council’s appeal of an adjudication officer’s decision. The officer had recommended €3,500 compensation and special arrangements for consultation and a possible return to Area A. The Court recommended retaining several directions on the worker’s location and duties, while applying normal consultation arrangements and limiting any first refusal right so it would not affect established arrangements for other workers. The Council argued that special arrangements could disrupt collective agreements; the union said the reassignment had lasted more than three years without meaningful review. The Court cited the case’s long duration and confusion over access to facilities in recommending the payment.
