The Labour Court recommended that Tipperary Rural And Business Development Limited pay Mr Coughlan an enhanced redundancy payment of €7,748.40. The recommendation was dated 11 July 2016. Mr Coughlan, a former specialist and lecturer at the institute, sought the payment at four weeks’ pay per year of service. He had already received €4,104 in statutory redundancy, paid by the liquidator after an Employment Appeals Tribunal award. The employer said it was in liquidation and argued that an enhanced payment was not feasible. The Court did not accept that liquidation distinguished the claim from similar earlier recommendations, noting it had been told surplus funds were likely after the company’s debts were discharged. It recommended payment of the full amount Mr Coughlan sought.
