The Labour Court recommended that West Wood Health Club pay a worker €1,200 compensation for the unfair manner in which it handled her dismissal. The recommendation was signed on 27 September 2013. The Court found the disciplinary investigation and procedure fell short of the required standards and that the dismissal could not be upheld. The worker said she was medically unfit to attend the disciplinary meeting and that it should have been postponed. She also objected that the same staff member had been involved in the initial incident and the investigation. The club did not attend the hearing or make written submissions. The Court also found that the worker’s actions contributed to the circumstances leading to her dismissal.
