Labour Court rejects HSE Dublin North East worker’s overtime claim

The Labour Court did not recommend conceding a worker’s claim for the same overtime rate as full-time colleagues. The recommendation was signed on 29 January 2013. The worker said she worked the same overtime hours but received a flat rate and sought compensation. HSE Dublin North East said overtime was paid under existing arrangements. The Court found the premium arrangements were governed by a collective agreement and applied to her; granting the claim would depart from that agreement, which the Court said it consistently upheld when freely negotiated and accepted by the majority covered.
