The Labour Court recommended that HSE Dublin Mid-Leinster set aside findings against a non-consultant hospital doctor and remove the related sanctions from her records. The Court was not satisfied that the HSE had complied with its disciplinary procedure. The recommendation was signed on 10 February 2011. The case concerned a written warning over the doctor’s handling of a patient’s ECG report. The Court said censure could be appropriate if a doctor failed to maintain a medical record, but recommended that the incident be discussed between the doctor and the Clinical Director. It said further investigation would be pointless after the passage of time.
