The Labour Court recommended that Bord Gais Eireann apply its R2000 Agreement loss-of-earnings formula to a gas fitter who moved into a Training Co-ordinator role. It also recommended that the Services Industrial Professional Technical Union accept the case as exceptional. The recommendation was signed on 21 January 2011. The union said the formula had been used in similar cases. The company said the worker knew the advertised terms and had been placed at the top of the new pay band. The Court found the company’s inconsistent past practice had created a legitimate expectation that the worker would receive compensation under the formula. It recommended applying the formula in this case, with the ordinary principle applying to future advertised roles unless otherwise agreed.
