The Labour Court recommended that M & P Sales & Marketing concede Mandate’s claim for redundancy terms matching those offered to other SHS Group workers. The recommendation was signed on 16 December 2010. Mandate said the affected workers should receive statutory redundancy plus four weeks’ pay per year of service, in line with other SHS Group employees. M & P Sales & Marketing said it was a separate legal entity and had offered statutory redundancy plus two weeks per year. The Court found the group operated as a single trading unit with one workforce and said different terms would be unfair to similarly affected workers.
