The Labour Court recommended that a Teagasc worker accept the plan to advertise the next available Westmeath/Offaly Post of Responsibility position in public relations and events. The recommendation was signed on 14 September 2010. The worker, represented by the Services Industrial Professional Technical Union, sought appointment to a responsibility post retrospectively from April 2007. He argued that the selection process had not followed agreed procedures and that a later competition would come too close to his planned retirement to benefit his pension. Teagasc said direct appointment would override interview results and disadvantage colleagues who scored higher. The Court saw no reason to vary the Stage 3 appeals outcome, which allowed the worker and other affected staff to apply for the next suitable post in the area.
