The Labour Court recommended that Health Service Executive South concede the Irish Nurses and Midwives Organisation’s claim to apply Circular HR13/2008 to 11 nurses in Cork and Kerry. The recommendation was signed on 8 March 2010. The union said the circular should apply retrospectively to the nurses, including one who had retired. HSE South argued they did not qualify because they had not been appointed to designated and approved pre-school officer posts. The Court found their work was substantively the same as that of the cited comparators and said they were covered by the circular.
