The Labour Court recommended that Eurospar pay a worker €3,000 after finding she had no alternative but to leave when her hours were substantially reduced and her schedule changed, increasing her childcare costs. The recommendation was signed on 27 November 2009. The worker’s hours fell from 37 to 20 a week after she returned from a week of sick leave. She said the new hours did not suit her circumstances and alleged discrimination. The Court’s recommendation addressed her constructive-dismissal claim. Eurospar told the Court it would not attend the hearing.
