The Labour Court recommended €10,000 compensation for a bin lorry driver dismissed after a dispute over whether management had instructed him to mix waste. The recommendation, signed on 24 September 2009, was made in the worker’s dispute with O'Meara Waste Disposal Trading As Mr Binman Clonmel, represented by the Services Industrial Professional Technical Union.

The company denied authorising the mixing and said the driver was dismissed after a disciplinary hearing for failing to follow instructions and trespassing on a customer’s property. The Court found there was a credible basis for a misunderstanding about how collections should be organised and did not consider the dismissal warranted or fair.

The worker was not seeking reinstatement. The Court recommended €10,000 compensation in full and final settlement of the dispute, and the union agreed to be bound by the recommendation.
