The Labour Court recommended that Leahys Pharmacy introduce a sick-pay scheme providing four weeks’ sick leave per year at full pay less social welfare, for employees who had completed probation. The recommendation was signed on 4 December 2008. Mandate sought six months’ paid sick leave, saying workers had previously been paid for all sick leave. Leahys Pharmacy said the previous owners used a discretionary system and offered five paid days per year. The Court did not accept that a sick-pay entitlement had been established through custom and practice. It recommended that the scheme exclude the first three days of an illness, require medical certificates and be reviewed after two years.
