The Labour Court recommended that Microsoft Ireland pay a former Product Marketing Manager €6,000 in compensation after finding that the disciplinary and termination processes fell short of good industrial relations practice. The recommendation was signed on 10 November 2005. Microsoft Ireland dismissed the worker during her six-month probationary period, saying her performance was unsatisfactory. She alleged that job requirements shifted, that she received inadequate support and that her dismissal followed concerns she had raised. The Court accepted that the company was entitled under her contract to end her employment, but said the way it handled the disciplinary and termination processes fell short of the terms and spirit of S.I. 146 of 2000.
