The Labour Court recommended that Schering-Plough (Brinny) Co recognise the Services Industrial Professional Technical Union’s (SIPTU) right to represent employees who were union members, both individually and collectively. The recommendation, dated 8 November 2005, concerned section leaders at the company’s Brinny plant in Innishannon, Co Cork. SIPTU sought negotiating rights on grievance and disciplinary matters, performance appraisals and potential redundancy negotiations. The union said the company had not honoured a commitment to involve it. The company argued that its internal procedures were fair and that issues could be discussed directly with management.
