The Labour Court recommended that crossing keepers on fixed weekly wages when a 1999 agreement was made keep an additional 12-hour payment personally until a restructuring is completed. The recommendation, signed on 12 November 2001, also called for a restructuring of the grade to be completed by the end of September 2002. Iarnrod Eireann and the Services Industrial Professional Technical Union disputed when the payment should end after rest days were provided. The Court said the company could discontinue it when an employee was given a rest day, but the agreement did not make clear that fewer weekly working days would mean losing the additional day’s pay. The Court recommended that the parties begin restructuring the grade and retain the payment for the specified workers until that process is complete.
