The Labour Court recommended against a worker’s claim to repay a pension clawback under a 12-month contribution option. The recommendation, signed on 17 November 1997, followed a dispute involving Fas and Services Industrial Professional Technical Union. The clawback related to 14.063 years of transferable Bord na Mona service for which spouses’ and children’s contributions had not been paid. The worker sought to repay it under a scheme provision allowing additional contributions over 12 months and at the salary rate that applied when he joined AnCO in 1974. Fas said the scheme did not allow that rate and that Finance would not approve the arrangement.
