The Labour Court found that Hempel Paints Ireland Limited acted unfairly in dismissing a worker who was an Administrative Manager in its Accounts Department. It recommended a lump sum equal to three months’ salary. The recommendation was signed on 1 April 1996. The worker said she took on extra duties during staff shortages, worked late and at weekends without extra pay, and received no warning before her dismissal. Hempel Paints said her performance was below standard, her probation was extended, and she was told at an appraisal what needed to improve. The company said it paid six weeks’ pay in lieu of notice.
