The Labour Court recommended that Dublin Airline Catering offer a dismissed catering assistant re-employment on a six-month probationary period. The recommendation was dated 19 October 1993. The worker had been dismissed after a physical altercation following a company function, where Gardaí intervened. Two other workers involved received a verbal reprimand and a final written warning. The company said the worker had performed well but declined to reinstate her, and did not attend the Labour Court investigation. The Services Industrial Professional Technical Union argued that the worker had been treated more harshly than her colleagues and sought her reinstatement. The Court found that she was to some extent a victim of circumstances beyond her making and that dismissal was too extreme a penalty, despite her probationary status. It recommended that she be offered re-employment.
