Labour Court recommends limited retirement clawback refund for pre-1947 Irish Rail entrants

By Rory Hanlon

Labour Court ·

In 1992, the Labour Court recommended a limited refund in a dispute between Irish Rail and the Rail Operative Trade Union Group/National Bus and Rail Union over a 40-hour clawback on retirement. The recommendation was signed on 8 January 1992. The Court confirmed the company’s interpretation of an earlier recommendation but conceded the union’s claim for employees who entered before 1947. It said the week to be refunded was the week deducted when an employee transferred out of the running department, at the rate applicable at the time.
