The Labour Court recommended that Irish Soft Drinks Limited pay the first 4% phase of the P.E.S.P. to workers represented by Services Industrial Professional Technical Union, effective from 18 March 1991. The recommendation was dated 17 December 1991. The union argued that production and sales had improved after restructuring and that the company had not substantiated its inability-to-pay claim. Irish Soft Drinks Limited said its recent restructuring and tight profit margins meant it could not afford the increase. The Court found merit in the union’s claim.
