In 1991, the Labour Court recommended that Gateaux Limited concede the Bakery And Food Workers Amalgamated Union's claim over redundancy selection in the sales force. The recommendation was dated 16 December 1991. The company had agreed to consider up to eight redundancy applications if the union submitted a list. It made eight salesmen redundant, including six from the union's list and two from the country sales force. The union sought redundancy and entitlements for the remaining two people on its list. The company said it had selected workers by seniority and was not obliged to accept all eight listed applicants. The Court said the agreement gave the company discretion over the number of redundancies, but that it had forfeited the right to choose between groups in the sales force because the union alone was responsible for forwarding names. It found the union had a reasonable expectation of redundancy payments for eight candidates.
