The Labour Court rejected the Irish Transport And General Workers' Union’s claim to reinstate a worker dismissed by Emerald City Productions Limited. The recommendation was signed on 4 December 1989. The union alleged that the worker’s dismissal was unfair and that he was singled out because of his union membership. The company said his attendance and conduct after re-engagement justified dismissal, and denied treating him differently because of union membership. The Court said that, given the worker’s attendance record after re-engagement, the company had not acted unfairly.
