The Labour Court recommended that Cantrell And Cochrane (Dublin) Limited maintain the hygiene overtime level covered by paragraph L of its 1986 agreement or negotiate compensation for buying it out. The recommendation was signed on 9 August 1989. The Irish Transport And General Workers' Union argued that the overtime was guaranteed even when machinery was not running. The company said it was payable only when cleaning work was available. The Court took account of a buy-out for employees engaged in hygiene overtime in 1984 when making its recommendation.
