The Labour Court did not recommend conceding the Manufacturing Science Finance union's claim against W & T Avery Limited for compensation over a worker's alleged unfair dismissal. The recommendation was signed on 5 September 1988. The worker had more than 21 years' service as a scale-maker. W & T Avery said it dismissed him after finding he was physically involved in a family coal business while registered as sick and unable to work. The union sought compensation, including for pension loss. An earlier Employment Appeals Tribunal had set aside a Rights Commissioner's compensation recommendation without deciding whether the dismissal was fair.
