WRC recommends charity waive about €1,650 debt after worker’s final pay was deducted

A charity should waive about €1,650 still owed by a former worker after recovering a salary overpayment in a way that caused hardship, a Workplace Relations Commission adjudication officer recommended in a decision dated 3 September 2026.

The worker had been overpaid while on sick and parental leave. The charity recouped money from her March and April 2025 pay, including most of her final salary. It said the deductions were lawful and that her resignation meant it had to recover as much as possible from her final pay.

The officer found the charity was entitled to recover the overpayment, but had not taken account of the hardship caused by stopping the worker’s income. The recommendation is to waive the remaining debt in final settlement of the dispute. The officer said the WRC had no jurisdiction over a Payment of Wages Act issue raised in submissions but not included in the complaint.
