WRC recommends €300 for worker misled by mistaken job contract

The WRC recommended that a support services organisation pay a worker €300 after an erroneous conditional contract led him to leave his porter job. Adjudication Officer Dónal Moore dated the recommendation 19 February 2026. The worker said he completed training and onboarding, signed a contract and gave notice at his existing job. The organisation said he had not passed mandatory training and that the contract was issued in error. Moore found the error had misled the worker to some degree, but the contract set no hours and guaranteed no work. He said the arrangement depended on successful training, and the worker had not completed the qualifying service needed to pursue relief for unfair dismissal under the 1977 Act. The worker had suffered some loss through reduced hours in his existing employment, but Moore said it could not be reliably calculated. He recommended €300 as full and final settlement. A section 13 recommendation is not legally binding.
