WRC recommends worker accept dismissal findings and sanction

The Workplace Relations Commission recommended that a worker accept the findings of a bullying and harassment investigation and the disciplinary sanction imposed by his employer. The recommendation was dated 23 July 2024. The worker disputed the fairness of the investigation and said dismissal was disproportionate. The IT solutions company said it had dismissed him for gross misconduct after a fair investigation and disciplinary hearing. The adjudication officer found the investigation fair, including the worker’s opportunity to comment on the draft report and attend a disciplinary hearing. The employer had not provided a promised opportunity to appeal the investigation report, but the worker was not prejudiced. He did not attend the later appeal hearing against dismissal, choosing to proceed with the WRC dispute.
