WRC recommends two extra days’ leave after disciplinary process lacked notice

The WRC recommended that a worker receive two additional days of annual leave after finding that his disciplinary process gave him inadequate notice of productivity issues. The recommendation was dated 14 September 2023 under section 13 of the Industrial Relations Act 1969. The employer said any flaw had been addressed on appeal and the verbal warning had expired. The adjudicator found the worker had not been given adequate notice before the initial hearing, leaving him without time to consider the allegations. The recommendation also said the worker and employer should address a communication issue with his supervisor through company procedures, including voluntary independent mediation.
