The Labour Court upheld the decision rejecting Gerry Daly’s complaint that Galway City Council penalised him for raising workplace safety concerns. The determination was signed on 22 December 2020.
Daly said the Council denied him weekend overtime on six dates in January 2019 after he raised safety concerns in December 2017. The Council said overtime depended on service demand and established practice, and that Daly worked overtime before and after the dates in question. The Court accepted his safety complaint was a protected act but found he had not established a detriment or a causal link between the complaint and the overtime allocation. It affirmed the Adjudication Officer’s decision.
