The Labour Court found Michael Hayes’s complaint that he was not paid for accrued annual leave when his engagement ended was not well founded. In its decision signed on 18 December 2025, it varied the Adjudication Officer’s decision, with no compensation awarded. The Minister for Enterprise, Trade & Employment argued Hayes was an office holder, not employed under a contract of service. Hayes argued that his work, remuneration and the control exercised over him brought him within the Act’s protections. The Court found he was not engaged under a contract of employment for the purposes of the Act.
