The Labour Court upheld the Adjudication Officer’s decision and dismissed Michael Morrin’s appeal over public holiday pay in a determination dated 6 January 2023. Morrin said regular rostered overtime and an eating-on-site allowance should be included in his public holiday pay. He cited a shortfall of €59.54 per public holiday and sought repayment for 12 years. Carlow County Council argued that overtime was excluded from the calculation and that the allowance compensated for an expense. The Court agreed that the regulations excluded overtime and found the allowance covered a cost incurred. It held that the Council had properly calculated Morrin’s public holiday pay during the period covered by the claim. The claim was not made out and the appeal failed.
