Labour Court overturns sea-fishing worker’s breaks decision

The Labour Court overturned a decision in Jose Pame Salandron’s favour after his employer, Ivan Wilde Limited, appealed his claim for statutory breaks under the Organisation of Working Time Act, 1997. The determination was signed on 19 September 2022. The Court found it had no jurisdiction because the claim concerned Part II of the Act, which does not apply to the fishing industry unless the Minister makes an order applying it. The complainant’s representative accepted that Part I did not cover the issues in the appeal. The merits were not decided.
